About the presentation:  The presentation on estate planning for non-taxable estates will focus on when to use joint trusts as opposed to separate trusts for a married couple; the advantages and disadvantages of disclaimer trusts; how to properly design General Durable Powers of Attorney and Patient Advocate Designations; funding trusts to maximize the step-up in basis; and the importance of ancillary documents such as Tangible Personal Property Memorandums, Digital Inventories, Funeral Arrangements, Funeral Representative Designations and Do Not Resuscitate forms.

The session on cryptocurrency will discuss the tax consequences associated with cryptocurrency and how to leave cryptocurrency to one’s heirs.

The session on estate planning will cover the methods of obtaining “Grantor Trust” status; toggling grantor trust status on and off; define value gifts; how to structure sale to a Grantor Trust.

  • When is a joint trust preferable over separate revocable trusts for married couples?
  • When is a disclaimer formula preferable over a reduced-to-zero marital deduction formula?
  • How to properly design General Durable Powers of Attorney and Patient Advocate Designation?

  • Advanced estate planning techniques in a low interest rate environment, including installment sales to potentially defective grantor trusts.

About the Speakers:

  • Julius H. Giarmaro, J.D., LL.M:  Mr. Giarmarco is chair of the firm's Trusts and Estates Practice Group. Julius received his law degree from Wayne State University, and his master of laws from New York University. He is licensed to practice law in both Michigan and New York.   • John J. Giarmarco, J.D., LL.M: Mr. Giarmarco received his Juris Doctorate from the Western Michigan University Thomas M. Cooley Law School, and his master of laws from the Heckerling Graduate Program in Estate Planning at The University of Miami School of Law. John's primary areas of practice are estate planning, wealth transfer planning, gift and estate tax returns, business succession planning, IRS tax controversies, eldercare law including Medicaid, Veterans Benefits, and Special Needs Trust consultation. John is licensed to practice law in Michigan and Arizona.
  • Ryan P. McNeil, J.D.: Mr. Ryan P. McNeil concentrates his practice in real estate, estate planning, trust and estate administration, and business planning matters. Ryan received his Juris Doctor degree from DePaul University College of Law with a certificate in Business Law and his Bachelor of Arts degree in Economics from the University of Michigan. He is a member of the Michigan Bar Sections: Probate and Estate Planning and Real Property and has presented for the Illinois Institute of Continuing Legal Education. Ryan is licensed to practice law in both Michigan and Illinois.
